These Terms of Service (the “Terms”) govern your access to and use of the PatchWorld virtual reality application, its related backend services and APIs, and any official integrations — including PatchWorld plugins, connectors, agent APIs, and Model Context Protocol (MCP) interfaces that let third-party AI assistants, AI agents, and AI tools (such as OpenAI’s ChatGPT) connect to your account (together, the “Service”).
The Service is provided by PatchXR AG (“PatchXR”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms incorporate our Privacy Policy by reference.

The Service is not intended for children under the age of 13 (or the higher applicable age of digital consent in your jurisdiction). By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
PatchWorld is a creative virtual reality platform for building music, instruments, visuals, and interactive virtual worlds out of modular “blocks” and “patches.” The Service includes:

To use the Service you are signed in through a supported identity provider (for example, your Meta account on the Meta Horizon platform). When you connect an Agent Integration — such as a third-party AI assistant, an autonomous agent, or an MCP client — you authorize it to access your PatchWorld account on your behalf through a secure authorization flow.
You are responsible for activity that occurs under your account and for keeping your credentials and any authorized connections secure. You may revoke a connected integration’s access at any time. Notify us at support@patchxr.com if you believe your account has been accessed without authorization.
Subject to these Terms, PatchXR grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own creative and non-infringing purposes. All rights not expressly granted are reserved by PatchXR.
You retain ownership of the original content you create within the Service, including patches, music, instruments, visuals, virtual worlds, and other assets (“User Content”).
You grant PatchXR a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, adapt (for technical purposes such as formatting and compression), and display your User Content solely to the extent necessary to operate, provide, secure, and improve the Service and to deliver the features you use (for example, saving worlds, enabling multiplayer, and processing AI or Agent Integration requests you initiate). When you choose to make content public or share it, you grant other users the rights necessary to view and interact with that content through the Service.
You are responsible for your User Content and represent that you have the rights necessary to create, upload, and share it, and that it does not infringe the rights of others or violate any law.
PatchWorld includes shared multiplayer worlds. When you voluntarily join a session, content you create or contribute may become part of that shared world and may be saved by another participant as part of that world. This reflects the collaborative nature of PatchWorld. Handling of such content is described further in our Privacy Policy.
The Service offers optional AI-powered features. AI output is generated automatically, may be inaccurate, incomplete, or unexpected, and is provided “as is.” You are responsible for reviewing AI output before relying on or publishing it.
If you connect PatchWorld to a third-party AI assistant, AI agent, or MCP client — such as OpenAI’s ChatGPT or any other MCP-compatible tool — your use of that assistant or agent is also governed by that provider’s own terms and policies (for example, OpenAI’s Terms of Use and Privacy Policy). PatchXR does not control, and is not responsible for, third-party assistants, agents, clients, their models, or how they process your conversations.
When you use an Agent Integration, the requests, tool calls, and content you (or an agent acting on your behalf) submit are transmitted to PatchWorld’s backend and MCP services to carry out the actions requested (such as reading or editing your patches), and results are returned to the assistant or agent so it can act and respond. You are responsible for the instructions you issue through connected assistants and agents, for any agent you authorize to act on your behalf, and for any content created or modified as a result. Do not use an Agent Integration to access or alter content you are not authorized to access, and ensure any autonomous agent you connect operates within these Terms.

We may remove content or suspend access that we reasonably believe violates these Terms.
The Service may offer in-app purchases, virtual items, entitlements, and in-app currency. Payments are processed by the applicable platform provider (for example, Meta), not by PatchXR; we receive only the purchase and entitlement confirmation necessary to unlock content. Virtual items and currency have no monetary value, are not redeemable for cash, and are licensed, not sold, to you. Except where required by law or by the platform provider’s policies, purchases are non-refundable.
The Service, including its software, blocks, design, branding, and documentation (excluding User Content), is owned by PatchXR or its licensors and is protected by intellectual property laws. “PatchWorld,” “PatchXR,” and associated logos are marks of PatchXR. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.
The Service operates on and interoperates with third-party platforms and services, including the Meta Horizon platform and third-party AI providers such as OpenAI. Your use of those platforms is subject to their respective terms and policies. We are not responsible for third-party platforms or for any acts or omissions of those providers.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content (including AI output) will be accurate or reliable. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
We may modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to provide notice of material changes where appropriate, but we are not liable for any modification, suspension, or discontinuation of the Service or any feature.
To the maximum extent permitted by applicable law, PatchXR and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) CHF 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence.
To the extent permitted by law, you agree to indemnify and hold PatchXR harmless from claims, damages, and reasonable expenses arising out of your User Content, your use of the Service, your use of connected third-party integrations, or your violation of these Terms or the rights of others.
You may stop using the Service at any time and may request deletion of your account as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms or applicable law, or to protect the Service or other users. Provisions that by their nature should survive termination (including Sections 6.2, 10, 12, 14, 15, and 17) will survive.
These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules. The courts at the registered seat of PatchXR AG (Volketswil, Switzerland) have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you may have in your country of residence.
We may update these Terms from time to time. Material changes will be reflected by updating the “Last Updated” date above and, where appropriate, through additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
